Terms of Use
Effective Date: October 19, 2026
These Terms of Use ("Terms") govern your access to and use of the Abacaxi website, desktop application, browser extension, and related services (collectively, the "Services"), which are provided by Abacaxi ("Abacaxi," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Services.
1. Acceptance of Terms
By creating an account, downloading the desktop application, installing the browser extension, or otherwise accessing the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
Abacaxi provides privacy-first, artificial-intelligence-assisted career tools. Our Services help you create and optimize resumes, draft cover letters, match job descriptions, and manage your job search. A core feature of the Services is that AI inference runs locally on your device using open-weight models, so your documents and personal data are not sent to our servers for model processing.
3. Eligibility and Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. When you create an account, you agree to provide accurate, current, and complete information and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law, regulation, or third-party right.
- Upload, transmit, or generate content that is unlawful, harmful, defamatory, infringing, or otherwise objectionable.
- Attempt to gain unauthorized access to the Services, other users' accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Services.
- Reverse engineer, decompile, or disassemble the software, except as expressly permitted by law.
- Resell, sublicense, or commercially exploit the Services without our prior written consent.
Compliance with Job-Site Terms of Service
Use of the Services is forbidden where prohibited by a job site's terms of service. The Abacaxi application and/or browser extension may only be used on sites whose terms of service permit such use.
Abacaxi does not facilitate, encourage, or enable use of the application or extension in a way that violates the terms of service of the job boards or company websites it works with, and the application and extension are not designed to bypass or circumvent any site's restrictions or anti-automation measures.
You are responsible for remaining compliant with the terms of service of the job sites you use. Abacaxi provides the tool; each user must ensure their own use of the application and extension (including scanning listings and autofilling forms) is permitted by the applicable site terms.
We reserve the right to suspend or terminate access for conduct that violates these Terms or that we reasonably determine to be harmful to the Services or other users.
5. Intellectual Property
The Services, including all software, designs, text, graphics, logos, and other content provided by Abacaxi, are owned by Abacaxi or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal use.
You retain ownership of the resumes, letters, and other documents that you create using the Services ("Your Content"). You grant us a limited license to process Your Content solely as necessary to provide and improve the Services.
6. Fees and Payment
Certain features of the Services, such as a desktop application license, are offered for a fee. Payments are processed by Paddle, our third-party payment processor. By purchasing a license or another paid feature, you agree to the applicable pricing and payment terms presented at the time of purchase. Fees are payable in advance. If a plan renews automatically, the billing interval is shown at checkout. Refunds and cancellation are described in Section 7 (Refund Policy). We do not store your full payment card details on our systems.
7. Refund Policy
All fees are non-refundable, except where a refund is required by law. This applies to a desktop application license and to any other paid feature. The desktop application can be evaluated free of charge for seven days before any payment is made, so a purchase is not the only way to confirm that the software runs on your machine and meets your needs.
Some jurisdictions give consumers a right to cancel a purchase and receive a refund, such as the right of withdrawal that applies in the European Union and the United Kingdom. Where that right applies it is honored, and nothing in these Terms limits a right you hold that cannot be waived by agreement.
If your plan renews automatically, cancel it through our support page before the renewal date so the next charge is not taken. Cancelling stops future charges; it does not refund a charge already taken, except where the law requires a refund.
Payments are processed by Paddle, our third-party payment processor, which handles the charge, the receipt, and any refund. An approved refund is issued to the original payment method, and how long it takes to appear depends on your bank or card issuer. Paddle's own buyer terms may give you a separate route to request a refund or dispute a charge, and those rights are not limited by these Terms.
To request a refund, contact us through our support page with the email address on your account and the receipt for the purchase. Contacting us before raising a chargeback with your bank or card issuer gives the fastest resolution.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Our Services are designed to process your career data locally on your device wherever possible.
9. Disclaimers
The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. AI-generated content is provided for convenience only and does not constitute professional, legal, or employment advice.
10. Limitation of Liability
To the maximum extent permitted by law, Abacaxi and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our aggregate liability arising out of these Terms shall not exceed the greater of the amount you paid to us in the twelve (12) months preceding the claim or one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify, defend, and hold harmless Abacaxi and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right; or (d) any content you submit, post, or transmit through the Services.
12. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will survive, including those relating to intellectual property, disclaimers, limitation of liability, and indemnification.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by other means. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States of America (federal law) and the State of California (state law), without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California, unless otherwise required by mandatory law applicable to you.
